Privacy Policy

This Privacy Policy ("Policy") PCC use and disclose your personal information collected through our websites and online services, including www.pacificcoffee.com, eshop-coffeesolutions.pacificcoffee.com, PCC Online Services, and other PCC owned or operated websites and online services that link to this policy (collectively, the “Sites”), through our programs and in our physical PCC stores ("Services"). This Policy does not apply to websites and services that display or link to different privacy statements. Websites and services co-branded with other partners may display or link to a joint privacy statement or separate privacy statements of our partners in addition to our Policy. By accessing the Sites or utilizing the Services, you hereby consent to the use of your information, including your personal information, any information of others provided by you, in the manner described in this Policy. Without limiting the generality of the foregoing, you authorize PCC to transmit your information outside Hong Kong in the manner and for the purposes described in this Policy.

 

1. What type of information may we collect and what is the purpose for collecting the data?

 

We only collect personal information that you want to provide to us or that is needed to provide (and improve) our service to you. We collect direct personal information such as name, address and e-mail address as well as indirect information such as cookies; connection and system information.

You may want to give us your e-mail address, name, telephone number etc. so that we can provide you with information on our products, enter you into our competitions or surveys, or just keep you updated about latest PCC developments that you are interested in.

Your personal information will be used for the purposes for which you provided it to PCC. It will also be used to administer, support and obtain feedback on the level of our services and to prevent breaches of security, the law or our contract terms.

Depending on how you interact with PCC (online, offline, over the phone, etc.), We collect various types of information from you, as described below:

 

1.1 Personal contact information. This includes any information you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.

 

1.2 Demographic information. Any information that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. zip code), favorite products, hobbies and interests, and household or lifestyle information.

 

1.3 Technical information about computer/mobile device. Any information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a PCC website or app via a mobile device such as a smartphone, the collected information will also include, where permitted, your phone’s unique device ID, advertising ID, geo-location, and other similar mobile device data. Websites/communication usage information. As you navigate through and interact with our Websites or newsletters, We use automatic data collection technologies to collect certain information about your actions. This includes information such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons, and is also collected through the use of third party tracking services (such as Double Click, Google Analytics, Adobe Dynamic Tag Management and/or Omniture). You have the right to object to the use of such technologies, for further details please see Section 2.

 

1.4 Consumer feedback. This includes information that you voluntarily share with Us about your experience of using our products and services.

 

1.5 Consumer-generated content. This refers to any content that you create and then share with Us on a social network or by uploading it to one of our Websites, including the use of social network apps such as Facebook. Examples include photos, videos, personal stories, or other similar media or content. Where permitted, We collect and publish consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, consumer engagement, and third party social networking.

 

1.6 Social network information. This refers to any information that you share publicly on a social network or information that is part of your profile on a third party social network (such as Facebook) and that you allow the third party social network to share with Us. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your social network profile information (or parts of it) every time you interact with a PCC websites on a social network such as Facebook, every time you use a social networking feature that is integrated within a PCC site (such as Facebook Connect) or every time you interact with Us through a social network. 1.7 Payment and Financial information. Any information that We need in order to fulfill an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We handle payment and financial information in a manner compliant with applicable laws, regulations and security standards such as PCI DSS.

 

1.8 Calls to Customer Relationship Centre (CRC). Communications with a CRC may be recorded, in accordance with applicable laws, for local operational needs (e.g. for quality or training purposes) and, in certain cases, to archive proof of consent for direct marketing and profiling. Payment card details are not recorded. Where required by law, you will be informed about such recording at the beginning of your call and will have the opportunity to object.

 

2. COOKIES ('TRACKING TECHNOLOGY')

 

PCC does make use of tracking technology ('Cookies') to gather such personal information as browser type and operating system, referring page, path through site, domain of ISP etc. for the purpose of understanding how visitors use this website. Cookies help us tailor this website to your personal needs.

 

PCC keeps all the information collected from cookies in a non-personally identifiable format. This type of information obtained through cookies will not be disclosed outside PCC or designated Third Parties. It will not be used for unsolicited communications.

Cookies located on your computer do not contain your name but an IP address. After the user's session is cancelled the information contained in the cookies is no longer available to PCC.

 

Please ensure that your computer setting reflects whether you are happy to accept cookies or not. You can set your browser to warn you before accepting cookies, or you can simply set it to refuse them, although you may not have access to all the features of this website if you do so. See your browser 'help' button for how you can do this. You do not need to have cookies on to use or navigate through many parts of this and other PCC websites. Remember that if you use different computers in different locations, you will need to ensure that each browser is adjusted to suit your cookie preferences.

 

3. How do we use information about you and others that you provided?

 

The following paragraphs describe the various purposes for which We collect and use your Personal Data, and the different types of Personal Data that are collected for each purpose. Please note that not all of the uses below will be relevant to every individual.

 

3.1 Customer service. We use your Personal Data for customer service purposes, including responding to your enquiries. This typically requires the use of certain personal contact information and information regarding the reason for your inquiry (e.g. order status, technical issue, product question/complaint, general question, etc.). Contests, marketing and other promotions. With your consent (where required), We use your Personal Data to provide you with information about goods or services (e.g. marketing communications or campaigns or promotions). This can be done via means such as email, ads, SMS, phone calls and postal mailings to the extent permitted by applicable laws. Some of our campaigns and promotions may be run on third party websites and/or social networks. This use of your Personal Data is voluntary, which means that you can oppose the processing of your Personal Data for this purpose. 3.2 Social networks: We use your Personal Data when you interact with third party social networking features, such as “Like” functions to serve you with advertisements and engage with you on social networks. You can learn more about how these features work, the profile data that We obtain about you, and find out how to opt out by reviewing the privacy notices of the relevant third party social networks.

 

3.3 Personalisation (offline and online). With your consent (where required), We use your Personal Data (i) to analyse your preferences and habits, (ii) to anticipate your needs based on our analysis of your profile, (iii) to improve and personalise your experience on our Websites and apps; to ensure that content from our Websites/apps is optimised for you and for your computer or device; and (iv) to allow you to participate in interactive features, when you choose to do so. For example, We remember your login ID/email address or screen name so that you can quickly login the next time you visit our site or so that you can easily retrieve the items you previously placed in your shopping cart. Based on this type of information, and with your consent (where required), We also show you specific PCC content or promotions that are tailored to your interests. The use of your Personal Data is voluntary, which means that you can oppose the processing of your personal data for this purpose. 3.4 Order fulfillment. We use your Personal Data to process and ship your orders, inform you about the status of your orders, correct addresses and conduct identity verification and other fraud detection activities. This involves the use of certain personal information and payment information.

 

3.5 Other general purposes (e.g. internal research, analytic, security). In accordance with applicable laws, We use your Personal Data for other general business purposes, such as conducting internal marketing and demographic studies and measuring the effectiveness of advertising campaigns. We reserve the right, should you have PCC Member accounts, to reconcile those accounts into one single account. We also use your Personal Data to ensure our security.

 

3.6 Legal reasons or merger/acquisition. In the event that PCC or its assets are acquired by, or merged with, another company including through bankruptcy, We may share your Personal Data with any of our legal successors. We may also disclose your Personal Data to third parties (i) when required by applicable law; (ii) in response to legal proceedings; (iii) in response to a request from a competent law enforcement agency; (iv) to protect our rights, privacy, safety or property, or the public; or (v) to enforce the terms of any agreement or the terms of our Website.

 

4. Do we share personal information or information of others that you provide with third parties?

 

  • We may share personal information in limited ways about you with others with your consent.
     
  • We may also share information with companies that provide support services to us (such as credit card processors or other payment services providers, mailing houses or website hosts) and that help us market our products and services (such as email vendors). These companies may use information about you to perform their functions on our behalf.
     
  • We may disclose specific information (i) upon lawful request, in response to legal process, and when required to comply with laws, (ii) to enforce our agreements with you, our corporate policies and Terms of Usage relating to your use of PCC products and services through the Sites or the Services, or (iii) to protect the rights, property or safety of PCC and affiliates, PCC Corporation and its subsidiaries and licensees, our employees, agents, customers, and others but only when it is reasonable to do so.
     
  • Data held by PCC relating to the PCC members is kept confidential by PCC, but each of the PCC members agrees that for the purposes set out in the above clause, PCC may transfer or disclose such information to the following parties (whether within or outside the Hong Kong Special Administrative Region):
    • any relevant service providers under a duty of confidentiality to PCC;
    • any agent, contractor or third party service provider (under a duty of confidentiality to PCC) who provides administrative, telecommunications, computer, payment, data processing or other services in connection with the operation of PCC's business;
    • any other person under a duty of confidentiality to PCC including PCC's subsidiaries, affiliates or business partners; and
    • any person to whom PCC, our subsidiaries, affiliates or business partners in (c) above, is under a binding obligation to make disclosure under the requirements of any law, rule and regulation, including those of countries outside of Hong Kong for data transferred to those countries, but such disclosure will only be made under proper authority.
       
  • In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of our business assets, PCC may disclose your statistics to those involved in the negotiation or personal information after the transfer.
     
  • We may also share aggregated or anonymized information that does not directly identify you. PCC will not retain your personal information one year after termination of your account and such information will be erased thereafter. Information of others that you have provided will be erased upon the termination of the purpose for which you provide such information.

 

5. How is personal information secured?

 

You can be confident that PCC takes all necessary measures to keep any personal information you send to us private and secure.

 

The collection of any personal data collected will be subject to our Personal Information Collection Statement. Personal data is stored securely via this website in its databases such as its Customer Relationship Marketing database. Your personal information will be kept by PCC only for as long as is reasonably necessary taking into consideration our need to answer queries or resolve problems, provide improved and new services and comply with legal requirements under applicable law(s). This means that we may retain your personal information for a reasonable period after you stop using PCC services or stop using this website. After this period, your personal information will be deleted from all systems in PCC.

 

Only authorized PCC staff, Third Party companies (i.e. service providers) staffs or business partner’s authorized staff (who have contractually agreed to keep all information secure) shall have access to the your personal data, and we do not release personal data to parties outside the group except as set out in our [Personal Information Collection Statements].  All PCC staff who have access to your personal information are required to adhere to the PCC Privacy Policy and all Third Party employees who have access to your personal information have signed privacy and non-disclosure agreements. In addition, contracts are in place with third-party companies that have access to your personal information, to make sure this information remains secure. To ensure your personal information is protected, PCC maintains a secure IT environment and has the appropriate measures in place to prevent unauthorised access (i.e. hacker).

 

6. Changes to our notice, Access to data and Correction

 

PCC will occasionally make changes and corrections to this Privacy Notice. Please check this Privacy Notice regularly to see the changes and how these may affect you.

 

Where provided by law, you, your successors, representatives and/or proxies have the right to access, review and request a physical or electronic copy of information held about you. You may also have the right to request access to and correction of your personal data by logging in via (eshop-coffeesolutions.pacificcoffee.com).
